Preamble

This privacy policy (The “Policy”) shall cover all the aspects of data collection, use and storage of different data segments from the end user (you). We as an organization (Chee Thee LLC) value the privacy of all of our clients and users. The policy includes security measures adopted by us in securing the safety of the end users (your) information. This policy shall be with regard to the information collected by Lettre.app and shall not include the collection or use of your information by any website or third party. The provisions of the Terms of Service (“TOS”) have been specifically incorporated herein by way of reference.

This Privacy Policy does not apply to the practices of companies that we do not own or control, such as companies that provide email, login and identity services. We do not control these third-party cookies and their privacy policies may differ from ours.

Collection of information

Lettre.app shall collect information from any and all individuals accessing the Applications or availing any of the Services. By accessing the Application, you consent to the collection and storage of certain information by Lettre.app. The information collected by us includes:

  1. User account information: Information provided by you while registering yourself, as well as information entered by you while creating a User Account. This shall include but not be limited to: information regarding your name, date of birth, one-time only location and contact information.

  2. Transaction and payment related information: Any information entered by you while making any payments in the Application through the App Store/Apple Pay, including but not limited to card details, account details and information related to the account holder is retained by Apple Lettre.app does not retain any payment details of user accounts.

The information we collect

Lettre.app collects a number of information about yourself and your activities related to the app. When you register yourself into the app, log in or use the app in general, we collect information like name and approximate (crude) location related information that you voluntarily share with the app. The examples listed here are not exhaustive and may expand in the future.

Email address: A valid email address is required in order for a person to open an account, verification or corroboration of identity, for communication regarding organizational terms and policy changes, as well as optional business and marketing related promotional campaigns (optional).

Device information: We receive and record information from your device, including your mobile device identification (IDFA (Apple), device ID, etc.), IP address, and approximated crude location (one-time only).

Activity and Usage: We collect non-personally identifiable information (non-PII) about the features you use, the pages and screens you visit, including information about your use of products or features offered through our Service. We strictly use this data to improve our products and services, and maintain that this data will not be used for retargeted advertisements or sale to other third parties.

Third Party Platform Registration (e.g. Facebook, App Store, Google Play): When you download or register for our Service by or through a third party platform, we may also access and/or collect certain information from your third party platform account. For example, if you create your account on our Service using your Google account, we may use your Google user ID to establish your account. In addition, in the course of providing our Service on third party platforms, such as Apple App Store, the platforms may collect information about you or receive information from us in order for that platform to provide and analyze their services. Please note that these platforms are developed and administered by people or companies not affiliated with us or any of our Services and that we are not responsible for the actions of those people or companies. You should carefully review the terms of service and privacy policies of the platforms that you use to access our Service.

Account related information

Deletion: Your account can be deleted any time by going to the ‘Settings’ option from the menu when you are logged in and after clicking on the ‘Delete Account’’ button. The account will be deactivated immediately but it may take a little time for Your account information and data to be completely removed from the App. Your profile information will be saved (for 30 days after which it will automatically be deleted) in case you decide to restore your Lettre.app Account. We reserve the right at our sole discretion to terminate or suspend any Account, or make use of any operational, technological, legal or other means available to enforce the Terms (including without limitation blocking specific IP addresses) as per our Community Guidelines, at any time without liability and without the need to give you prior notice.

Third parties: We are not responsible for (and don’t have any control over) the privacy policies of third party websites, apps and ad servers. We encourage you to read the privacy policies of each and every website and app you visit.

Location:   Your crude and approximate location information is collected when you first register with Lettre.app, via your express approval. By approximate location information we refer to a scale at which individual users cannot be located (street or city) but can be approximated (country or continent). “Tracking” mechanisms particularly are not at play here, but we do collect location information from your device or browser when you log in or use the app. To protect your privacy and security, we do not collect or share your precise location.

Use of information collected

We collect certain information from Users for the following purposes:

1.       Account Creation: All of the information entered by you at the time of creating an account shall be used to create a profile for you in the Application. The information may also be used to verify Users identity. Certain parts of the information collected may also be displayed on the User’s profile in the Application.

2.       Providing Services: The most important and primary intention of collecting information from Users is to provide you with our Services.

3.       Communication: The contact information collected from you shall also be used to send you occasional communication with regard to the Application and the Services. By accessing the Application or by using any of the Services you consent to receiving communication from Lettre.app. You will have the option to opt out of receiving communication from Lettre.app.

4.      Improvement and research: The information and feedback collected from you shall also be used for improving upon our Services and Applications as well as to develop further Services as per your requirements and needs.

5.     Bug fixes and product improvement: To find and fix technology problems, we send data to companies we do not own in order to analyze bugs in our Apps so that we can keep them running smoothly.

6.     Policy related communication: We use the collected information to communicate with users In order to enforce and update all related parties of our privacy policies and terms of agreement.

7.       Contacting users: To contact you, including to invite you to participate in surveys and contests, and provide you updates and information about the Service and our other products and services.

08.   Law Enforcement: We cooperate with government and law enforcement officials to enforce and comply with the law. We report threats of violence or self-harm and other illegal activities proactively, and we may disclose information about you to government or law enforcement officials in order to: (1) protect the safety and security of our users and members of the public (2) satisfy subpoenas, court orders, or other governmental requests. Additional clauses from our Community Guidelines may be applicable here.

09.   Business Transfers: We may share your personal information with another business entity in connection with a proposed or actual sale, assignment, merger or transfer of all or part of our business or the acquisition of all or part of another business. In such cases, we would require any such business entity to honor the terms of this Privacy Policy for existing users, although the business entity might see fit to introduce new policies for new users.

10.   Management: We may process your information as needed to maintain our financial books and records, engage in sales of goods and services to members and stakeholders, ensure the integrity and security of our systems and resources, operate our work environment, and respond to any potential compromise of anyone’s personal information.

11.   Services providers: We transfer information to vendors, service providers, and other partners who support our business, such as providing technical infrastructure services, analyzing how our services are used, measuring the effectiveness of ads and services, providing customer service, or conducting research and surveys. These partners agree to adhere to confidentiality obligations consistent with this Privacy Policy and the agreements we enter into with them.

12.  Personal Information: Except for “Cooperation with Law Enforcement,” “Business Transfers” and “Service Providers” (all described above), in connection with account verification (and then only for that purpose), or to enforce our rights under this Privacy Policy and our Terms of Service, we do not share the following personal information with any third party not owned by CheeThee LLC for any reason: your first name, your last name, your address, your phone number(s), or your email address.

Disclosure of information

Lettre.app does not under any circumstances sell or trade any User information. All disclosures made shall be notified to the User and where reasonable Lettre.app shall attempt to obtain your consent prior to disclosing your information. Lettre.app may, while rendering its Services to you, disclose certain parts of your information to its employees, directors, service providers, representatives, subsidiaries and associates.

All such disclosures shall be made only on a ‘need to’ basis. All of **Lettre.app’**s employees that access your information shall be bound by a Non-Disclosure Agreement (NDA) and they shall be required to obtain appropriate consent and authorization prior to accessing any User information. Lettre.app may also be required to make certain disclosures regarding the Users information to comply with any applicable law or in compliance with any order or direction received from any court or governmental authority.

However, Lettre.app shall have no duty of confidentiality over any information that is shared, disclosed or made public anywhere in the Applications by the User. In the event of a merger or acquisition of or by Lettre.app, Lettre.app shall disclose certain information to the acquired/acquiring entity. Lettre.app shall also disclose certain User information for the purposes of protecting its employees and other Users.

Security and storage of information

Lettre.app employs safety and security measures, both technical and administrative, at par with the industrial standards. Lettre.app shall, as is reasonable, protect all of the information collected and stored on its servers against any loss, theft, destruction or misuse. However, none of the measures adopted by Lettre.app may prove effective in protecting the User information and you hereby acknowledge and accept the same. You shall be solely responsible in maintaining the safety of your respective User Account. Users are advised against disclosing any account details to any third party. Lettre.app shall not be liable for any unauthorized access or use of your User Account. Lettre.app shall have no duty of confidentiality over any of the following information:

i. Any information already available in the public domain.

ii. Any information posted, uploaded, distributed or published on any public feature of the Applications.

iii. Any information made public due to no fault of Lettre.app.

Lettre.app also takes sufficient and reasonable measures to protect cross border communication and data at rest and in transit, and to ensure steps against accidental loss, theft, misuse, duplication and destruction of user data.

Management of information

Lettre.app encourages Users to keep any and all of their information stored on Lettre.app updated. Users are also requested to ensure that all such information is accurate, correct and up to date. You may at any time revoke any of the consents previously granted to Lettre.app with regard to the collection and storage of your information. However, such denial may adversely affect your access to the Applications as well as the access to and availability of certain Services. Lettre.app shall grant you the right to manage your information stored on Lettre.app’s servers subject to certain limitations, including but not limited to:

i. In the event your access to the information compromises the safety of any other information stored on Lettre.app’s servers.

ii. In the event that the cost of editing or updating your information outweighs the need for the same.

Amendments

Lettre.app reserves the right to remove, alter or change the whole or any part of this Policy at any time and prior notice may be provided to you before major revisions in order to obtain consent from users. The revised Policy shall be made available on the Website and your continued use of the Applications and the Services shall be deemed as your acceptance of the revised Policy, other than cases where we ask for your explicit approval of consent.

End User License Agreement (EULA)

This End User License Agreement (EULA) is a legally binding document that you (”the user”) and Lettre.app (”the app”, ”the application”, “the application owner”) agree into explicitly. This EULA will remain in effect until you opt out, or until you continue to use the app or its features as described in the agreement.

The EULA aims to describe all the usage rights as afforded to you when you download, sign up, or in any way use the Lettre app or any of its designed features.

END USER LICENSE AGREEMENT

This End User License Agreement ("Agreement") is a legal agreement between you ("User" or "you") and CheeThee LLC ("Company," "we," "our," or "us") for the use of the Lettre app ("App"). By installing, accessing, or using the App, you agree to be bound by the terms and conditions of this Agreement. If you do not agree to these terms, please do not use the App.

1. License Grant

Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App solely for your personal, non-commercial use.

2. User Data

To provide the services of the App, we may collect and store personal data including but not limited to your Name, Email Address, Phone Number, and any other associated personal data that may be publicly available following a third-party login to the App. We are committed to protecting your privacy and handling your data in accordance with our Privacy Policy. By using the App, you consent to the collection, use, and storage of your data as outlined in our Privacy Policy.

3. User Content

The App allows you to write letters to other users ("User Content"). You retain all ownership rights to your User Content, however, once a letter is sent to another user, ownership of User Content is transferred to the recipient. All User Content is subject to the Community Guidelines outlined by the App.

4. Restrictions

You agree not to:

a. Use the App for any unlawful purpose or in any manner inconsistent with this Agreement. b. Modify, adapt, translate, reverse engineer, de-compile, disassemble, or attempt to discover the source code of the App. c. Remove, alter, or obscure any copyright, trademark, or other proprietary rights notices from the App. d. Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity. e. Interfere with or disrupt the operation of the App or the servers or networks used to make the App available.

5. Termination

We may terminate this Agreement and your access to the App at any time, without prior notice, if your conduct on the App does not comply with our Community Guidelines. You may receive a notification of the termination of your access via email. If you feel your access should not have been revoked and you want to appeal the decision, please refer to the Community Guidelines of the App.

6. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APP; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE APP; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

8. Governing Law

This Agreement is governed by and construed in accordance with the laws of the United States of America, without regard to its conflict of law principles.

9. Modifications

We reserve the right to modify or revise this Agreement at any time. Your continued use of the App after any such changes signifies your acceptance of the modified Agreement.

Our Data Retention and Deletion Policy

DATA RETENTION AND DELETION POLICY

This Data Retention and Deletion Policy ("Policy") outlines how CheeThee LLC ("Company," "we," "our," or "us") handles the retention and deletion of personal data in accordance with the European General Data Protection Regulation (GDPR) and other applicable data protection laws. This Policy is an integral part of the End User License Agreement ("Agreement") for the Lettre app ("App"). Capitalized terms used but not defined in this Policy have the meanings given to them in the Agreement.

1. Data Retention

We retain personal data for as long as necessary to fulfill the purposes outlined in our Privacy Policy and as required by applicable laws. The retention periods may vary based on the type of data and the legal obligations that apply.

2. User Data Collection

The App collects personal data including but not limited to Name, Email Address, Phone Number, and other associated personal data that may be publicly available following a third-party login to the App. We collect and process this data for the purpose of providing the App's services and features, not to retarget for ads or sell to other third parties.

3. User Content

User Content, including letters, are stored on our servers for as long as you maintain an active account. If you delete your account or request deletion of specific User Content, we will remove the associated data in accordance with this Policy. In order to request a data deletion, please send an email to info@cheethee.com

4. Deletion Requests

You have the right to request the deletion of your personal data. To initiate a deletion request, please contact us at info@cheethee.com. Upon receiving a valid deletion request, we will review and process the request within a reasonable timeframe. Users may also request an account deletion through the app itself, after which the user will be signed out permanently and all User Content will be removed.

5. Backup and Archiving

Please note that certain personal data may be retained in backup and archival systems for a limited period of time for legitimate business purposes, such as data recovery and system integrity. These copies are securely isolated and are not actively used for any operational purposes. They will not be used for advertisement targeting or commercial sale to other third parties.

6. Legal Obligations

We may retain personal data for longer periods if required to comply with legal obligations, resolve disputes, enforce agreements, or protect our rights and interests.

7. Children's Data

If you are under the age of 16 and wish to have your personal data deleted, please obtain consent from a parent or legal guardian before making a deletion request.

Lettre Community Guidelines

Welcome to Lettre, a platform where users can connect through handwritten digital letters and discover pen pals from around the world who share their interests. To ensure a safe and respectful environment for all our members, we have established the following community guidelines. By using Lettre, you agree to abide by these rules:

1. Respect and Kindness:

  • Treat all users with respect, kindness, and empathy, just as you would in a face-to-face conversation.

  • Avoid discriminatory language or any form of hate speech based on race, gender, religion, sexual orientation, or any other personal characteristics. Avoid using language that is discriminatory, threatening, abusive, or defamatory.

2. Privacy and Personal Information:

  • Protect your own privacy and the privacy of others. Do not share personal contact information or sensitive details in public areas of the app. This includes addresses, phone numbers, email addresses, and other private data.

  • Respect users' boundaries and consent when initiating conversations or sharing content.

  • Any content shared on the platform that contains personally identifiable information is assumed to have been shared willingly and Lettre or its parent company CheeThee LLC cannot be held liable for malicious use of that information outside of the app’s purview.

3. Authenticity and Honesty:

  • Be genuine and honest in your interactions. Do not pretend to be someone you're not, including other users or app staff. Impersonating other real people and sharing their private information publicly is a punishable offense and will be treated as such.

  • Report any suspicious or dishonest behavior to our moderation team.

  • Misrepresentation of certain facts, figures, historical events or commonly accepted narratives may be counted as a violation of terms of use and Lettre’s community guidelines.

4. Content Guidelines:

  • Ensure that all handwritten digital letters and content shared on the platform adhere to our guidelines.

  • Do not share explicit or offensive material, including nudity, violence, or explicit language.

  • Always respect copyrights, trademarks, and other intellectual property rights. Only share content that you have the right to distribute.

  • Any user generated content is assumed to be the responsibility of the user and any opinions, views, inclinations or topics of conversation that may be generated as part of correspondence on Lettre’s platform is entirely attributed to the users themselves. Lettre or its parent company CheeThee LLC are not liable for any views expressed in one to one communication done via the Lettre app.

5. Shared Interests and Conversations:

  • Engage in conversations centered around shared interests, hobbies, and passions.

  • Encourage positive and constructive discussions among the community.

6. Reporting and Moderation:

  • Report any content or users who violate our guidelines. If you come across content or behavior that violates our guidelines or seems suspicious, please use our in-app reporting features or contact our support team.

  • Our moderation team will investigate reported content and take appropriate action, which may include warnings, suspensions, or account termination. The moderation team may take steps to obtain more information regarding a reported incident or user generated content, and will take all necessary steps to ensure fair judgement of a reported incident.

7. No Harassment or Bullying:

  • Do not engage in any form of harassment, cyberbullying, or trolling.

  • Respect other users' boundaries and consent when initiating conversations.

8. Cultural Sensitivity:

  • Be mindful of cultural differences when communicating with users from diverse backgrounds.

  • Avoid making assumptions or generalizations based on cultural stereotypes.

9. No Spam or Solicitation:

  • Do not use the platform for spamming, advertising, or solicitation of any kind.

  • Only share promotional content in designated areas, if allowed by the platform's rules.

10. Child Safety:

  • Lettre is intended for users of an appropriate age, and we do not recommend allowing access to the app for anyone below the age of 16 without parental supervision, irrespective of location, nationality, creed or gender.

  • Do not engage in conversations with minors if you are not of the same age group.

  • Report any suspicious activity involving minors to our moderation team immediately via info@cheethee.com.

    • Familiarize yourself with our Terms of Service and abide by all the rules and policies outlined there.

11. Compliance with Terms of Service:

  • Abide by the laws of your local jurisdiction, even if they differ from these guidelines.

  • Promoting or engaging in illegal activities, harmful challenges, self-harm, or anything that can endanger someone's physical and mental well-being is strictly prohibited and may result in legal action being taken against those who violate the terms of service thus far outlined.

  • Violation of these guidelines may result in the removal of content, temporary suspension, or permanent banning from the app, at the discretion of our moderation team.

12. Continuous Improvement:

  • Provide feedback and suggestions to help us improve the Lettre community and user experience by emailing info@cheethee.com.

Failure to comply with these community guidelines may result in various consequences, including warnings, suspensions, or account termination.
